Microsoft, Adobe and 6 IT firms can't file green cards right now. Here's what that means for you

On 8 October 2026 the US Department of Labor announced it had suspended seven employers from PERM, the labour certification that starts most employer-sponsored green cards. Cognizant had been suspended in September. Together these 8 employers filed 23,795 H-1B applications (LCAs) in fiscal year 2026, so a lot of people are asking the same thing: what happens to me?

Checked October 2026

The 8 employers, and how many H-1B workers they file for

H-1B Labor Condition Applications certified in fiscal year 2026, from the Department of Labor's own disclosure data:

  • Cognizant: 5,766 (suspended in September 2026)
  • Microsoft: 5,107
  • Infosys: 4,553
  • Tata Consultancy Services: 2,881
  • Wipro: 1,535
  • Capgemini: 1,468
  • HCL Technologies: 1,457
  • Adobe: 1,028

What is paused, and what is not

Paused: new PERM applications from these employers, and work on PERM cases they had already filed. Without PERM, most employment-based green cards (EB-2 and EB-3) can't move forward with that employer.

Not paused: your H-1B. The suspension doesn't cancel H-1B status or your right to work, and reports say approvals finalised before 8 October stand. One knock-on to watch: extensions beyond the six-year H-1B limit often depend on a pending PERM or I-140, so ask your employer's immigration team how your case is affected.

How long: no end date has been announced. Reports point to 20 CFR 656.31, which allows an initial suspension of up to 180 days, extendable while an investigation or court case is open.

Why it happened

The administration says the employers are being investigated for possible visa fraud or misrepresentation. It was announced at a White House event, and on 31 October the Labor Department still had not posted a written notice, so details may change. Microsoft disputes the claims, which have not been tested in court.

If your green card was going through one of these 8

A PERM belongs to the employer, not to you. A new employer can file a fresh PERM for you, and this suspension doesn't stop that. In most cases an approved I-140 priority date can carry over to a new employer's case. Moving is a big decision, so talk to an immigration attorney first.

Employers that file many H-1B transfers are the quickest route, because hiring you costs them no lottery risk. On 31 October these were the biggest transfer filers we track with open tech roles:

  • Amazon: 940 transfer positions filed in FY2026, 1,831 open tech roles
  • Google: 733 transfers, 847 open roles
  • Apple: 524 transfers, 259 open roles
  • Nvidia: 334 transfers, 658 open roles
  • Fidelity Investments: 318 transfers, 127 open roles
  • Salesforce: 290 transfers, 155 open roles
  • Cisco: 272 transfers, 275 open roles
  • Oracle: 270 transfers, 294 open roles
  • Capital One: 157 transfers, 867 open roles (351 of its ads say they sponsor)

Common questions

Does the PERM suspension cancel my H-1B?

Which companies are suspended from PERM?
Microsoft, Adobe, Infosys, Tata Consultancy Services, Wipro, HCL Technologies and Capgemini (announced 8 October 2026), and Cognizant (September 2026).
How long will the PERM suspension last?
No end date has been announced. The rule reports cite allows an initial 180 days, extendable while an investigation or court case is ongoing.
